Terms of Service

The agreement between you and ScrapeSilo for use of the API, dashboard, and related services.

These Terms of Service (the "Terms") govern your access to and use of ScrapeSilo — the web-scraping API, dashboard, documentation, and any related services (together, the "Services"). By creating an account, minting an API key, or otherwise using the Services, you agree to these Terms. If you are using the Services on behalf of an organization, you accept these Terms on its behalf and confirm you are authorized to do so. If you do not agree, do not use the Services.

1. The Services

ScrapeSilo lets you fetch and extract structured data from web pages you direct it to, through a typed action language, an AI planning engine, or a real browser runtime. You send the target URLs and the extraction instructions; we run them and return the result. We may add, change, or remove features over time, and we will make reasonable efforts to keep current functionality available, but the Services are provided on an evolving basis.

2. Accounts and API keys

You must provide accurate account information and keep it current. API keys are credentials: you are responsible for keeping them secret and for all activity that occurs under your account or keys, whether or not you authorized it. Notify us promptly at support@scrapesilo.com if you believe a key has been compromised. You may revoke and re-issue keys at any time from your dashboard. You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Services.

3. Acceptable use

Your use of the Services is subject to our Acceptable Use Policy, which is incorporated into these Terms by reference. In short: you are solely responsible for the targets you scrape, the data you collect, and your compliance with all applicable laws and the terms of the sites you access. Scraping is a powerful tool, and the legality of any given scrape depends on what you scrape, where, and why — that determination is yours to make before you run a request, not ours.

4. Your data and content

As between you and us, you own the extraction instructions you submit and the data the Services return to you (your "Content"). You grant us a limited licence to process, transmit, and store your Content only as needed to operate the Services, secure them, and support you. We do not sell your Content, and we do not use the data you scrape to train models. We may record browser scrape sessions for your own inspection and debugging where that feature is enabled; those recordings are part of your Content.

You represent that you have the rights necessary to submit your Content and to have us process it on your behalf, and that doing so does not violate any law or any third party's rights.

5. Our intellectual property

The Services — including the software, API design, documentation, and branding — are owned by ScrapeSilo and protected by intellectual-property laws. These Terms grant you a limited, non-exclusive, non-transferable, revocable right to use the Services as permitted here. You may not copy, resell, reverse-engineer, or create a competing service from the Services, or remove any proprietary notices.

6. Plans, credits, and payment

Paid plans are billed in advance on a recurring monthly basis through our third-party payment processor. Each plan includes a monthly pool of credits; scrapes consume credits weighted by the engine used, as described in the pricing documentation. Credits reset at the start of each billing period and do not roll over. You authorize us and our payment processor to charge your payment method for all fees due. Fees are exclusive of taxes, which you are responsible for where applicable. We may change pricing on a prospective basis with reasonable notice; changes do not affect the period you have already paid for.

7. Service availability and quotas

We aim for high availability but do not guarantee the Services will be uninterrupted or error-free. We enforce rate, concurrency, and credit limits to keep the platform stable; requests that exceed your plan's limits are rejected with the documented 402 or 429 responses. We may perform maintenance, impose reasonable limits, or temporarily suspend access to protect the integrity of the Services.

8. Suspension and termination

You may stop using the Services and close your account at any time. We may suspend or terminate your access, with or without notice, if you breach these Terms or the Acceptable Use Policy, fail to pay, create risk or legal exposure for us or others, or use the Services in a way that harms the platform or third parties. On termination, your right to use the Services ends; your historical execution records may remain queryable for a limited period, and outstanding fees remain due. Sections that by their nature should survive termination (ownership, disclaimers, limitation of liability, indemnification, and governing law) will survive.

9. Disclaimers

The Services are provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Services will meet your requirements, that extraction results will be complete or accurate for any given page, or that any target site will remain accessible or unchanged. We are not responsible for the content of the third-party pages you choose to scrape, nor for the consequences of your scraping them.

10. Limitation of liability

To the maximum extent permitted by law, ScrapeSilo will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or relating to the Services or these Terms, even if advised of the possibility. Our total aggregate liability for all claims relating to the Services will not exceed the greater of (a) the amount you paid us for the Services in the three (3) months immediately before the event giving rise to the claim, or (b) one hundred US dollars (US$100).

11. Indemnification

You will defend, indemnify, and hold harmless ScrapeSilo and its personnel from and against any claims, damages, liabilities, and reasonable expenses (including legal fees) arising out of or related to your use of the Services, your Content, the targets you scrape, the data you collect, or your breach of these Terms or of any law or third-party right.

12. Changes to these Terms

We may update these Terms from time to time. If we make a material change, we will update the "last updated" date above and, where appropriate, notify you. Your continued use of the Services after a change takes effect constitutes acceptance of the revised Terms.

13. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. The state and federal courts located in Delaware will have exclusive jurisdiction over any dispute that is not subject to binding arbitration or a small-claims action, and you consent to their jurisdiction and venue. If any provision of these Terms is held unenforceable, the remaining provisions stay in effect.
